Terms & Conditions

Acknowledgement and acceptance of your order

You will need to provide us with your e-mail address and we will notify you by e-mail as soon as possible to confirm receipt and confirm details of your order. An acceptance of your order will take place on dispatch of the good(s) ordered.

 

Availability

Our acceptance of your offer to purchase our goods is subject to their availability. Our acknowledgement of order acceptance via the web or email is not a guarantee of delivery. If we are unable to deliver the goods which you have offered to purchase we will tell you as quickly as possible and a full refund will be given. Please note that dispatch estimates are not guaranteed and that dispatch times should not be relied upon as such.

All items available on our website may not be available in every bricks and mortar store. We would advise our customers to phone the store in question and confirm they have the stock in question before making any long journeys. 

 

Cancellation By Us

We reserve the right to cancel the contract between us if: 

- we have insufficient stock to deliver the goods you have ordered;

- we do not deliver to your area; or

- one or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by  us from our suppliers.  

If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 21 days of your order.

 

Cancellation Rights

Under the Distance Selling Regulations you have the legal right to cancel your order within seven days of receipt of your goods (with the exception of any made to order items). You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty. However, you will need to notify us if you wish to cancel your contract.

If you have received the goods before you cancel your contract then you must send the goods back to our contact address at your own cost and risk. If you cancel your contract but we have already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to us at our contact address at your own cost and risk as soon as possible.

Once you have notified us that you are cancelling your contract, any sum debited to us from your credit card will be re-credited to your account as soon as possible and in any event within 21 days of your order.

You will be re-credited for the costs incurred in returning faulty or unsatisfactory goods.

Damaged or Faulty goods

Any damaged or faulty goods received must be highlighted to us within 48hrs of receipt. Please contact us if your item is faulty. info@mcconnellshoes.co.uk

 

Delivery

Please note that additional charges may be applied for the Isle of Wight, the Isle of Man, the Channel Isles, the Scottish Isles, parts of Highland Scotland and the ROI Isles.

We will deliver the goods to the address you specify for delivery in your order. It is important that this address is accurate. Please be precise about where you would like the goods left if you are out when we deliver. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions (unless this is caused by our negligence). We will aim to deliver the goods by the date quoted for delivery but delivery times are not guaranteed. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we will contact you to arrange an alternative date.

You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

How Long will delivery take?

Standard Delivery

Orders will be delivered within 2-5 working days (unless stated otherwise in the table above), excluding weekends and bank holidays.

2-Day Delivery

For 2-day delivery orders must be placed before 1pm Monday to Friday and if in stock are guaranteed to arrive within 48hrs (excluding Saturday and Sunday). Orders placed on weekends and bank holidays will be processed on the next working day, for delivery in 48 hrs. There may be some remote areas where our couriers are unable to guarantee delivery within 48 hours.

Next Day Delivery

For next day delivery orders must be placed before 1pm Monday to Friday and if in stock are guaranteed on the next working day. Orders placed on weekends and bank holidays will be processed on the next working day, for delivery the day after. There may be some remote areas where our couriers are unable to guarantee delivery within 24 hours.

Collect in Store (Northern Ireland only)

Please note: If you do not collect your order within two weeks from the date the order was processed, we will automatically refund the order and you will be charged a £5 administration fee.

Keeping You Informed

We'll email you updates to let you know how the delivery is going. Some email accounts will 'Junk' any emails that are sent from addresses that are not recognised, so make sure you add info@mcconnellshoes.co.uk  to your address book so that we can get in touch with you! If you don't receive your order within the maximum delivery time for your country and if you've not received any tracking emails please get in touch and we'll be happy to track the order for you.

 

Law Jurisdiction and language

This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with Northern Irish law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of Northern Ireland. All contracts are concluded in English. 

 

Liability

If you do not receive goods ordered by you within 30 days of the date on which you ordered them, we will have no liability to you unless you notify us in writing at our contact address of the problem within 60 days of the date on which you ordered the goods (unless this is not reasonably practicable).  If you notify a problem to us under this condition, our only obligation will be, at your option:

- to make good any shortage or non-delivery;
- to replace or repair any goods that are damaged or defective; or
- to refund to you the amount paid by you for the goods in question in whatever way we choose.
- Both parties shall only be liable under this contract for losses, which are a reasonably foreseeable consequence of the relevant breach of  contract. 

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site.  The importation or exportation of certain of our goods to you may be prohibited by certain national laws.  We make no representation and accept no liability in respect of the export or import of the goods you purchase.

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

Returns

We make every effort to ensure that your order is carefully dispatched to you, and we hope that you’re happy with your purchase. However, if you have any cause for dissatisfaction with your goods you may return them. Items must be unworn, in their original condition and packaging and returned within 14 days of receiving them. Please ensure shoes are only tried on indoors on carpeted surfaces. Do not write on, tape or glue anything to the box.

You should follow the procedure below.

In Store

You can return the items to any McConnell Shoes store, within 14 days of receipt. What to do:-

Take your items to be returned as well as your sales receipt and returns form (We will not be able to process your return without this document) to a McConnell Shoes store.  If the item(s) is in its original condition and packaging, we will process the return for you. The money will be returned to the account you used to pay for the goods on the website. Please allow up to 14 days for this to appear in your account.

ii) Return by post

You can return or exchange any items to us, within 14 days of receipt of goods, free of charge (UK only). What to do:-

Please call us or email us to organise your return, quoting your reference number. We will e-mail you a returns label and details of your nearest drop off point. Complete the returns form and enclose it, together with your returned items, inside the original packaging. Goods cannot be returned or refunded without this information.
 
With the exception of faulty or damaged goods, if you return your purchase by post or courier after the 14 day period, we reserve the right to not offer you a refund in full. We will instead return your purchase to you and prior to sending it out, we will charge you the delivery fee that is applicable to the product purchased and the location to which your returns will be delivered. 

 

If the item is in its original condition and packaging, and is returned within 14 days, we will process the refund for you. Please allow up to 14 days for this to appear in your account. 

Christmas Returns Policy

Usually, we ask you to return any unwanted items within 14 days.

At Christmas, we know that's not always possible as items are bought in advance and given as gifts at Christmas time. So if you're ordering items now for Christmas presents, you may return them up to 5th January, as long as they have not been worn or used, and have the original labels attached.

 

Risk and Ownership

Risk of damage to or loss of the goods passes to you at the time of delivery to you, or if you fail to take delivery at the agreed time, the time when we successfully deliver. You will only own the goods once they have been successfully delivered and when we have received cleared payment in full. Goods supplied are not for resale

 

Security

We endeavour to take all reasonable steps to protect your personal information.  However, we cannot guarantee the security of any data that you disclose online and we will not be responsible for any breach of security unless this is due to our negligence or wilful default.

 

The Contract between Us

We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Your payment of the price for the goods represents an offer on your part to purchase the goods, which will be accepted to us when we send to you an email that the goods have been sent to you. Our acceptance of your order brings into existence a legally binding contract between us.

If, after we have confirmed your order, we discover any unforeseen reason as to why we cannot complete it, we will cancel your order, in full or in part, and advise you by email, text or phone call, and refund when necessary..
